We do not transfer legal ownership of items from the seller to the buyer, and nothing in this agreement shall modify the governing provisions. Further, we cannot guarantee continuous or secure access to our services, and operation of the Sites may be interfered with by numerous factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of our Sites. TruckersAuctions.com will consider the circumstances of an alleged offense and the user's trading record before taking action. Disciplinary action may range from a formal warning up to indefinite suspension of a user's account. However, out of fairness to all users, if a complaint cannot be proven with certainty, TruckersAuctions.com will not take action. We retain the right to decide what we investigate or not. Transfer your TruckersAuctions.com account (including feedback) and User ID to another party without our consent. Distribute or post- spam, chain letters, or pyramid schemes. Unpaid Item PolicyBuyers automatically enter into a legally binding contract to purchase the item from the seller if they win the online auction or use the Buy It Now feature. TruckersAuctions.com's Unpaid Item policy requires buyers to pay the seller for the items that they commit to purchase.Sellers can file an unpaid dispute with TruckersAuctions.com for each of their items that are purchased but not paid for. TruckersAuctions.com will issue a strike on the account of the buyer who does not honor their obligation to pay (unless the buyer and seller mutually agree not to complete the transaction).Note: If a buyer gets too many strikes in too short a time period, their account will be suspended indefinitely. In some cases, limits may be placed on the buyer’s account in advance of suspension Non-binding Bid PolicyCertain TruckersAuctions.com online auctions involve non-binding bids. Non-binding bidding is not a contract between seller and buyer. However, non-binding bids represent a buyer’s serious expression of interest in buying the seller’s item. Furthermore, insincere bidding is not permitted. Invalid Bid Retraction PolicyA bid is a binding contract. Except under special circumstances, bid retraction is not permitted. Furthermore, misuse of the bid retraction option to manipulate the bidding process is not permitted. This includes any manipulation of the bidding process to discover the maximum bid of the current high bidder or to uncover the reserve price. Unwelcome and Malicious BuyingBuyers who do not meet the seller’s terms as outlined in the item listing are not permitted to bid on or buy the item. Furthermore, buyers are not permitted to place bids or purchase items with the primary intent of disrupting a listing.Sellers are permitted to exclude bidders at any time prior to the listing close and are free to cancel unwelcome bids. After a seller has cancelled a bid, the bidder may not place a new bid without the seller's permission. Shill BiddingShill Bidding is bidding that artificially increases an item’s price or apparent desirability, or bidding by individuals with a level of access to the seller’s item information not available to the general Community. Shill Bidding is prohibited on TruckersAuctions.com. TruckersAuctions.com strongly encourages sellers with employees to ensure that their employees are aware of this policy and the possible consequences of violation.If you believe that another member is artificially raising the price or desirability of an item by shill bidding please report it to TruckersAuctions.com. Your Feedback Profile includes a Feedback Score, as well as comments from your transaction partner’s. As an TruckersAuctions.com member; you should use caution and good judgment when leaving Feedback for another member. What you write will be a permanent part of that member’s record on TruckersAuctions.com. Feedback-related policies is designed to encourage open and honest trading. However, to ensure that Feedback is used for the proper purpose and not abused, TruckersAuctions.com has some basic rules that must be followed. Members cannot undermine the Feedback system using practices such as: Threatening to leave negative or neutral feedback for another member unless the other member provides goods or services not included in the original listing. Feedback left or received where the Feedback’s primary value is to artificially enhance a member’s reputation.
